Contract

Using our web site or placing an order indicates your acceptance of these terms and conditions. Please read them carefully. The submission of an order form and payment will be treated as an offer by you to purchase goods from us subject to these terms and conditions.

By agreeing to these terms and conditions before you place an order means you are over 18 years old.

 

Remittance Terms
Goods sold remain the property of Wicked Brewing, until paid in full, under UK Law. Errors and omissions are not accepted. This does not affect your statutory rights.

Description of Goods

The description of items offered for sale on our web sites are provided by the product manufacturer or their UK agents/distributors. Product photographs and other images may contain changes to the product (such as the grape variety on a wine kit). Some product images and the final product may look slightly different. You should also consider colours and quality of the image may vary slightly from computer to computer and therefore should only be considered as a guide.

From time to time a manufacturer may change or improve the product slightly without notification - this may include the packing, ingredients, materials used, size etc. While we constantly monitor the goods supplied to us and update our web site accordingly it is impossible to be 100% accurate and the goods we supply may not match the descriptions or photographs exactly. The products supplied to you will be the current version as supplied in the UK to us by the manufacturer or distributor.

 

Stock

All stock on the web site is subject to being in stock, as the site is not a live ordering system and there is a possibility of stock not being available. If this occurs, you will be informed and offered your product when it becomes available or a refund.

 

 

Purchase

Your order becomes binding as soon as we have accepted it and payment has been made. All orders are subject to availability. 

We reserve the right to cancel any order without prior notice and explanation. In this instance we will make the request for all monies to be refunded to the card/bank account used to make the purchase within 5 days.

We reserve the right to refuse to supply any individual or company.

Many companies may be involved in the delivery of your order, therefore any delivery date specified cannot form part of the contract. We will always attempt to meet any delivery date specified, all orders are delivered on a best effort basis.

 

Payment

We accept debit / credit card payments.

Please note we can't accept an international payment and delivery to the UK, you need to place the order with a UK card registered to a UK address.

Wicked Brewing only accepts orders from the UK which is subject to 20.00% VAT. Some items such as grains are VAT free.

Guarantee

If an item is broken / leaking, please inform us within 10 working days of receiving the item and we will arrange a replacement within 3 working days. (Subject to stock holding)

Please note mail order is mail order, some cans will arrive with dents in, we always try our best to pack the parcels correctly, but dents do happen, we don’t class a dent as damage as the kits are still usable. But if they are badly dented / leaking then we will replace them.

 

Returns Policy

Your rights to return goods are protected under The Consumer Protection (Distance Selling) Regulations 2000 which can be found at; http://www.legislation.gov.uk/uksi/2000/2334/contents/made

If you have any problems, please e-mail wickedbrewing@outlook.com and we will endeavour to sort out the problem.

Please report non-delivery after 10 days of placing the order and it must be before 30 days. If over 30 days there is nothing we can do to find your parcel, refund for the goods, or anything, it is down to you to let us know of a problem.

After 30 days there is nothing further Wicked Brewing can do, and no refund will be issued. It is the responsibility of the customer to notify, by email wickedbrewing@outlook.com of any non-delivery as soon as possible after 10 days of placing the order and before 30 days.

If you fail to respond to cards or any communication that have been left by us or the carriers and the parcel is returned to us via the carrier. We will refund the cost of the goods minus an administration charge of £18.00, to negate the cost of the parcel being returned to us through our courier.

If the goods are faulty they will be replaced free of charge or a full refund given if sent back within 10 days of receiving the goods. The nature of the defect/damage must be communicated to us via email, with a photograph to wickedbrewing@outlook.com, within 3 days of receipt of delivery. Please do not return any product without instructions to do so.

We accept no liability for loss or damage during return transit and recommend you take out adequate transit insurance to cover the full cost of the order in case of damage, loss or theft during transit. Confirmation of posting is no guarantee of delivery and items should be sent via an insured "signed for" service.

We consider 7 days to be a reasonable time in which to return the goods to us and you should use an appropriate delivery method to ensure the products reach us within this time period.

If the products have been used or the blister packing has been opened and/or are not in the original condition (this excludes packaging added by us and used to protect the goods during transit), we are unable to issue a full refund. However, we may issue a partial refund less a restocking fee of 25% of the product value. This is subject to our discretion and we are unable to guarantee this for every product we sell. If we are unable to accept the return, you will be responsible for the full cost of returning the items to you. This includes any charges incurred by us when you returned the goods. We will retain the items for a maximum of 14 days. If payment for re-delivery is not received within this period, we will assume the goods are not required and will be disposed of.

We do not accept returns for goods/items that have been opened.

If the goods are ordered in error, we will refund the goods in full if they are in their original condition and packaging (unopened, not used or worn), but we cannot refund the carriage. We must receive these goods within 7 days of the goods being delivered/signed for. We will refund your money within 30 days of us receiving the goods. Please note when sending the goods back get a proof of posting and insure the goods in case they get lost.

If we have sent the goods, with FREE P&P we have the right to remove the cost of the P&P before we refund the cost of the goods.

If the goods get lost on return, we cannot refund any money, but you should be able to make a claim through your delivery company you used to return the goods i.e. UK Mail/Royal mail.

We cannot refund items that are in an unsaleable condition i.e. have been used. unless they are faulty and within the manufacturer’s warranty period.

We can only credit the card/bank account used to make the original payment. This is in accordance with UK anti-fraud and money laundering regulations. All refunds will be made as soon as possible and no longer than 30 days after cancellation.

This does not affect your statutory rights.

 

Missing/Incorrect Items

If you believe that there may be item(s) missing or incorrect from your order, please contact us within 3 working days of signing for your order and we will investigate. This may involve us speaking to third party companies involved in the supply and delivery of your items and may take a few days to complete.

 

Complaints

Complaints are handled on a one to one basis by e-mail with photographic evidence and we will try and come to a satisfactory conclusion within 3 days of the complaint, all complaints will remain confidential and fair.

 

Privacy Policy

Wicked Brewing does not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.

We do not send random marketing emails to personal email addresses (spam).

 

Legal concerns

It is illegal to manufacture spirits in the UK without a distiller's licence which is required under the provisions of section 12 of the Alcoholic Liquor Duties Act 1979 and this includes manufacture for "own/domestic use".

Public Notice 39 - "Spirits production in the UK" dated July 2006 provides further information about HM Revenue and Custom's requirements.

Please note the Still Sprits flavourings and yeast are legal (as long as you DON'T distil to get the higher alcohol). As you are either fermenting the yeast or using duty paid vodka to use with the flavourings then the Still Spirit range is legal to use and enjoy in the UK.
